Powers and Functions of the Authority

The Authority manages and control the following powers and functions through the Board:

• invite applications for licences or accept any applications without such invitation, subject to the provisions of the Act;
• consider, grant or refuse applications in terms of this Act;
• cancel, suspend, vary, renew or revoke a licence or registration approved by it subject to this Act;
• furnish a report or recommendation to the responsible Member on a matter referred to it or requested by the responsible Member;
• exercise any other power conferred or imposed in terms of this Act or any other law on the Authority or board;
• exercise any power necessary to conduct the business, manage the administration and finances of the Free State Gambling and Liquor Authority, which includes, amongst others, entering into agreements, attend to litigation, lease property for the operations of the Authority;
• condone, on good cause shown, any immaterial non-compliance with the provisions of the Act;
• co-opt persons, without voting rights, who is able to assist the board with a specific matter where special skills are required

Composition of the board

The members of the board shall be appointed by the responsible Member of the Executive Council in consultation with the Executive Council, and shall, subject to subsection (3), consist of:

• 1 member who is qualified to be admitted to practice as a legal practitioner in the Republic and has, for a cumulative period of at least 5 years after having so qualified, practised as a legal practitioner or performed service related to the application or administration of the law;
• 1 member who is qualified as a chartered accountant in the Republic and has, for a cumulative period of at least 5 years after having so qualified, practised as a chartered accountant;
• 1 member who has knowledge of, and experience in, the tourism industry;
• a person representing the Department of Economic Affairs and Tourism of the Province, designated by the responsible Member;
• a person representing the Department of Finance of the Province, designated by the Member of the Executive Council responsible for Finance;
• not more than 4 members who shall have proven business acumen or knowledge of the gambling industry or who are suitable for appointment to the board.

The responsible Member shall appoint a member of the board as the chairperson and another member as the deputy chairperson, of the board. The chief executive officer of the board shall ex officio be a member of the board. If the chairperson is absent or is for any reason unable to act as chairperson, the deputy chairperson shall perform the functions of the chairperson.

Tenure of office

A member of the board shallhold office for such period, not exceeding 3 years, as the responsible Member may determine at the time of his or her appointment and shall be eligible for reappointment at the termination of his or her term of office.

Committees of the board

The board may from time to time appoint a committee to exercise the powers and perform the functions delegated or assigned to it by the board. A committee shall consist of:

• such members of the board as the board may designate; or
• such members of the board as the board may designate and such other persons as the board may co-opt in terms of section 19.

The board shall designate the chairperson of a committee. A committee shall exercise its powers and perform its functions subject to the provisions of this Act and such directives of the board as are not in conflict with such provisions. Any delegated power or function so exercised or performed shall be deemed to have been exercised or performed by the board.
